On 11th Feb it will be 6 months since our Bankruptcy. The OR said at our interview that she would discharge after 6 months - can we get in touch with her to ask or do we just wait? Thanks for all your help - nearly out the other side!

Yes, you can contact the OR and ask about the status of your bankruptcy. There is no problem with asking and getting an update.

Hi Jon,

Had a letter today offering early discharge - we need to send them an income expenditure form and then they will ask the creditors adn the process will take some weeks to complete, is it worth it or shall we just wait for the automatic discharge promised in the letter.

Could you tell me the ups and downs of this option?

Hi,

If the Official Receiver sends you a notice asking for information, be it income and expenses or whatever, you need to comply and complete the form and send it back. If you do not do this, it may be seen as not cooperating with the OR.

Why would you not fill it out and send it back? They are only looking to see if your circumstance has changed and if you now may have some surplus income to pay into the bankruptcy. They have until discharge to do this. If nothing has changed, then there is no issue.

An early discharge means the time line between your bankruptcy and being out of bankruptcy, debt free, and starting fresh, begins sooner.

plz help, i was just made bankrupt by work partner last week, now i have the tax to pay but i did not mentioned this in court would this still wipe off my tax as well?
