What if I want to claim back mis-sold PPi and I am or have gone bankrupt?


The insolvency service has addressed this and any refund or claim becomes the property of the Official Receiver or Trustee handling or who handled the bankruptcy. And if a bankrupt is considering placing a claim, they need to notify the Receiver/Trustee as again, the claim will go towards the bankruptcy. This even after being discharged. More on this can be found at the government’s insolvency web site.

Many people I have heard from feel this in unfair, they should receive the claim, and I understand what they are saying. However the banks and the insolvency service feel that the refund was attached or a part of the debts that were included and discharged in bankruptcy, the bankrupt benefited from the bankruptcy and being relieved of the debts. Any claim or refund should stay with the bankruptcy to help offset that loss.

The Insolvency Service has spoken. And while we may not agree with what they are saying, if you are bankrupt r even have been discharged from bankruptcy and have a PPI claim in, you need to be aware of the insolvency service's stance.
