My husband has been in business for years but lately his business is down a lot and he cannot make ends meet and is considering going bankrupt.

 

I am worried about myself and our children.  We have been married 5 years, and have two childen 8 and 5.  All the accounts are in my husband's name as it is all related to his business.

 

We have a property that I bought before we had even met and it has alwasy ben in my name.

 

Can they take the property if he goes bankrupt?

I am about to go bankrupt and am worried about my wife.  The property we live in is in her name alone and I have never paid anything towards the house at all.  Will they take her house if I go bankrupt?

I owe around £40K, am now unemployed and age 64.
Married 15 years. My wife owned her house before marriage and it was never transferred to joint names - i.e. she still is the sole owner.

Will Bankruptcy Affect My Spouse's House?

I have about 32k in debt, mainly credit cards and loan. I am on incapacity benefit and hope one day to return to work. I have a payment plan and have advised that bankruptcy is really my only way of clearing the debt, as I have no real income to afford payments of my debt.

Yourquestion:   I have just got married and am keen to clear my debt, and have been advised to go bankrupt. My reservation is how it will affect my husband and his credit and also could he be forced to sell the house.

All the debt is in my name and I have had it long before I met him, also the house is his, I have just moved in with him when we got married. He bought the house 3 yrs before he met me, and its his name on the deeds. He pays all the bills, all I contribute towards is food shopping and fuel for his car, as he drives me places.

My main concern is the house and the effects bankruptcy would have.

I am considering going bankrupt but am worried about my husband and his house.  I am not on the mortgage or on the property in anyway but have lived with him here for over 10 years and have been told since I have help to pay the mortgage I have an interest in the house.  What may happen if I go bankrupt?

I currently have debts of 30k and have come to the point where i can no longer pay these, i am married with two young children. the debts are totally in my name only, we have a mortgage but my name is not on the mortgage and the car is also in my wifes name. i have looked into my assetts which are basically none, i just need to know that if i did choose bankcrupcy would it be possible for anyone to touch the house or anything else that is in my wifes name. ?

If I Go Bankrupt Can They Claim My Wife's House?

Was a self employed builder and had to give up work in 2008 due to illness, mental health problems. My debts are around 20,000.00.
Since becoming ill I have not been able to repay any of the debts due to low income but now having problems with the debts and having to sort them out.
I live with my wife and two children (aged 4 and 13) and my wife owns the house, she bought it before we met.

Their question: If I have to go bankrupt, will the people i owe money to be able to make a claim against the house?
