My mum died a few years back and left her house to me, my brother and my sister.  I am soon to be made bankrupt by someone I owe money to.  Can they take this property?  I only own a part of it.

My husband and I split up 2 years ago and we have a joint mortgage on a property which I live in with our daughter.  He has now informed me he went bankrupt a few months ago and I have been contracted by someone who states they have my ex’s interest in the property and will want this paid or they will sell the house in a few years.  Can they do this?

My Girlfriend lives in a property with her 2 kids. her ex pays the mortgage, but her name is also on the mortgage, she has sorted a new mortgage to keep the property and give her ex a payment of £30,000, to remove him from the property. He has now informed her that he cant wait for the money and will have to go bankrupt and the property will be sold.

Yourquestion:   Will the house be taken from her, or is she able to get the property from the receiver if he does go bankrupt.

My ex husband has told me he intends to go bankrupt. we divorced in 2005 a consent order was set in place saying when he was paid a fixed ammount he was to take his name of the deeds and mortgate. He was paid in 2007 but the bank would not take his name off the deeds and mortgate due to other debt he had run up that i had taken on to keep my home.

Their question: If he goes bankrupt how will this afftect me? We have a statement of deed saying he has been paid. the court order states when he is paid he has no legal right to the property or finances. but like most consent orders the only records are mine and my ex husbands that state he was paid and the consent orderwas part implemented. How will this affect me.

FAMILY MEMBER OWNS PART SHARE IN LAND.

Their question: fAMILY MEMBER WENT BANKRUPT ABOUT 3 YEARS AGO AND DID NOT DECLARE INTEREST IN JOINT OWNERSHIP OF LAND. CAN THEIR BE ANY KIND OF FRAUD IF FOUND OUT?

My marriage broke down 3 yrs ago, my husband moved out of our joint home, I had to sell the house. He gave me his share of the equity approx £15000 to help me purchase another house. I had to put in £25000 of my pension money to buy, My husbands relationship broke down, so he went to work for a company with live in accomodation. In October 2010 he was made redundant and had no where to live. So I took him back.

Their question: My husband owes 21000 for a loan and £5000 to a credit card, he has just got a job but the hourly rate is not enough to cover his debts and live. If he goes Bankrupt would a charge me made against my house. I can prove I had put in monies of my own. If I was to sell my house my I would not get back the equity I personally put into it. Also would he lose his car he needs it for work and it is valued about 3000 max. thank you

How Can I Keep My House In Bankruptcy?

I own a 3 bedroom house in Stowmarket. It is worth about £169000 (guessing but maybe less) and I owe £167000 (£5000 of which is a secured loan).
I am also going through a divorce (the house is in my sole name) albeit my wife has lodged some kind of "interest" with the Land registery.
I have approx £32000 of unsecured debt but due to my CSA payments (25% of my wages), Iam finding this harder and harder to pay my debt. I have no disposable income for an IVA and am aware that Bankruptcy is the maybe the best way forward. I am so deperate to keep my house though (wife has now moved on and lives elsewhere and has done for 2 years). I have never missed a payment on anything yet but am getting to the stage that I am always in my overdraft more and more.

Their question: i understand i can keep my house if I find the money for the difference in mortgage and value. How do i do this and how do I make the OR aware that this is what I wasnt to do?
Is it a definate thing that if the difference is found, I can keep my house?
Also, how do i make te mortgage company aware that this is what I want to do (santaner who are my bank account and mortgate provider). I obviously need to get another bank account and pay from there, nut do I do this before filing for Bankruptcy?
What effect does the "interest" lodged on the house by my wife has if any?
Do you know if, in these circumstances, the CSA would reduce the payments?
How soon after the application has been made and a court decision reached, is it for me to ask to be discharged?
