Is Bankruptcy An Option For Us?

I am a retired Police officer recieving a £15000 pension. My wife and I are currently out of work and the pension is our only income. this money does not cover all our bills and I am very worried that we will not be able to keep paying our mortgage and othe other bills forcing us to be homeless

Yourquestion:   1, Is bankcruptsy an option and would it help us stay in our house?
2. Other advice please
was previously married and have several personal and joint debts with ex husband.  i am now remarried and struggling to pay old debts (total approx £65000.00 altogether) i do have arrangements in place with creditors to pay token payments each month but there is no way i will ever be able to clear these

Yourquestion:   i currently do not work (have children) my income is solely tax credits, child benefit and maintenance. my new husband does work. i already know that he is not liable for my debt as he is not named on any of it. however if i declare myself bankrupct would it affect him /his possesions/his income/savings etc. and if so,  in what way?
thanks

What Is Considered Income For An IPA?

I'm considering going bankrupt. I understand that if you do so, you enter into an Income Payment Agreement (IPA) based on your income.

Yourquestion:   I understand that State Benefits such as jobseekers or DLA aren't considered when an IPA/IPO is made, as they're for your basic living costs and not considered surplus. What about statutory sick pay? It's not classed as a state benefit because it comes from your employer, and it's pennies more than basic JSA.

If you're receiving SSP, do they take any of it, even though it's not much more than what they don't take if you're just unemployed?
my ex husband pays me child maintenance do i have to declare this on my bankruptcy petition

Our Services

If you have a serious debt problem, bankruptcy can free you from your debts within 12 months. As a solution for dealing with serious debt, bankruptcy is a last resort. Other debt solutions need to be explored first, to help determine if bankruptcy is the right debt solution for you.

Your financial affairs are put into the hands of an Official Receiver or Trustee, who will control all your assets - and if you own a property, this will also be included. These will be sold and the money used to pay as much as possible to your creditors.

There are consequences to bankruptcy which will affect your finances and work life. You may struggle to borrow money, for example, and will not be able to apply for certain jobs.

For some, bankruptcy is the right option and will put an end to pressure from creditors. Our team of experts are on hand to advise on the best solution to your debt problems - call now on 0800 002 9951.
