What Happens To My Pension In Bankruptcy?

Written by Jon
I have real concerns about my circumstance and what may occur.  I am in arrears with just about everything as I took out a couple of payday loans on top of my already high debts and now it is all crashing down.  I have a decent job, I just cannot afford to pay what they are asking.  I am considering bankruptcy but am worried about my pension.

Will I Lose My Pension In Bankruptcy?

Written by Jon
I am soon to be made bankrupt and am OK with this as I own no property and have nothing really to lose but the debts.  My concern is my pension.  Will I lose my pension and can I still make contributions to it?

Will I Lose My Pensions In Bankruptcy?

Written by Jon
My father is 77 and has large debts (£50k+) and no assets. He has two private pensions at £650 (gross) per month and receives a state pension at a similar level. He had previously entered into an IVA which was defaulted on. He has been conned and all of his money is controlled by a 3rd party. I am intervening to 'rescue' him and try and find what's the best way forward for him financially.

Yourquestion:   Should he declare bankruptcy does he lose his pensions? How easy would it be to declare bankruptcy with debts at the levels above? How do I find all debts currently in his name other than those he has paperwork for?

Our Services

If you have a serious debt problem, bankruptcy can free you from your debts within 12 months. As a solution for dealing with serious debt, bankruptcy is a last resort. Other debt solutions need to be explored first, to help determine if bankruptcy is the right debt solution for you.

Your financial affairs are put into the hands of an Official Receiver or Trustee, who will control all your assets - and if you own a property, this will also be included. These will be sold and the money used to pay as much as possible to your creditors.

There are consequences to bankruptcy which will affect your finances and work life. You may struggle to borrow money, for example, and will not be able to apply for certain jobs.

For some, bankruptcy is the right option and will put an end to pressure from creditors. Our team of experts are on hand to advise on the best solution to your debt problems - call now on 0800 002 9951.
