Can I Take Out A Loan Prior To Going Bankrupt?

Written by Jon
I am currently going through a divorce and have around 25,100 of debt. I have £27'000 equity in my jointly owned house, but as my wife's family are solicitors, trying to get the money out of the house is like getting bloody from a stone. My legall fees are currently up to £3000' and are likely to be triple that by the end. I am going to have to take a loan to cover the extra legal fees, which will push me to far over the edge and I will be unable to make payments on my debts and survive

Yourquestion:   If I was to take a loan out for my legall fees then declare my self bankrupt, would that be allowed, or would they say I have just taken the loan to make myself bankrupt? Any help would be greatly appreciated as I am in a terrible place.

Can My Bankruptcy Be Refused?

Written by Jon
I am having to declare myself bankrupt due to gambling debts. This is 100% of the reason.

Yourquestion:   I am soon to attempt to declare myself bankrupt but would like some advice on writing the 'statement of affairs'. I have no idea what to write and how to write it.
Do I just write an essay on the series of events that got me into this mess or do I simply write what the situation is now? Should I also include that I am seeking help for my addiction?
Any help would be much appreciated.
Also, is there much likelyhood that my bankruptcy would be refused? One of my family members are willing to pay the bankruptcy fee for me and I do not want it to be wasted.
Thanks.

Our Services

If you have a serious debt problem, bankruptcy can free you from your debts within 12 months. As a solution for dealing with serious debt, bankruptcy is a last resort. Other debt solutions need to be explored first, to help determine if bankruptcy is the right debt solution for you.

Your financial affairs are put into the hands of an Official Receiver or Trustee, who will control all your assets - and if you own a property, this will also be included. These will be sold and the money used to pay as much as possible to your creditors.

There are consequences to bankruptcy which will affect your finances and work life. You may struggle to borrow money, for example, and will not be able to apply for certain jobs.

For some, bankruptcy is the right option and will put an end to pressure from creditors. Our team of experts are on hand to advise on the best solution to your debt problems - call now on 0800 002 9951.
