Question:
My ex husband declared himself bankrupt july 2009. We divorced in 2008 with a consent order which entitled him to none of the equity when our house was sold. The trustees of the bankruptcy have asked that 50% of the equity be retained until all their enquiries have been made. This has been ongoing since December. How can I speed things up. They seem to be taking a long time despite the consent order which I understand cannot be overturned.
Answer:
This sounds as though it is more of legal matter and as such you may need to consult a solicitor.
Even though you had a consent order with your ex-husband stating he was not entitled to any equity in a property, there have been cases where the Trustees in a bankruptcy have challenged this.
So again, you may want to speak to the trustees involved as to their time-frame for the matter, and also consult a solicitor.
Thank you for letting me help you.
