Can I Go Bankrupt In The UK?

I had lived in Uk on work permits as NEw Zealand citizen. I have had to leave the UK as I do not have right of abode. I have approx 22 grand of debt.
It would be extremely difficult to settle this debt from NZ with or without income. No current income.
My wife is British, she has a property in her maiden name but we sha no bank accounts, my name is not on the mortgage etc.
I have a pension fund in UK worth approx 20 grand.

Yourquestion:   Can I go bankrupt in the UK?
Will my wife's house be affected? Will she be considered bankrupt with me? Can my pension fund be used to pay my debt?

Answer:  If you now reside outside the UK and are not a UK national, it may be difficult to go bankrupt, but if you have not been outside the UK for more than three years, you should be able to go bankrupt and have a respresentative do this for you.

 

Your wife's house should be OK if you go bankrupt as long as your name is not on the property and you have not contributed to the property.

 

Many pensions are protected in bankruptcy, so unless you liquidate the pension to pay or settle the debts, chances are it would not be taken for the bankruptcy.
