my fiancee has a property with a ex partner. he has an
IVA and because he hasnt paid this they have put his 25K debt on the property. they have been apart for 4 years. Because of his debt my fiancee is the one suffering from this affecting her creit rating and also the house is stuck in limbo, it will also affect her when remortage is due. As this is all down to him and his debt is there anyway of getting him off the mortage of frocing bankruptcy on him. My fiancee is stuck and tied to him he wont sign the house over or sell it as it is 10k in negative equity. He wont pay for repairs as he is broke and when remortage is due it will be sky high because of his iva and debt he has put on theproperty. He wont go bankrupt so his debt is affecting my fiancee its not right my fiancee should be paying for this from an ex from 4 years and his debt. Any advice please either forcing bankruptcy or getting him off the mortage
many thanks for your time
Answer: You may want to have her speak to a solicitor as to my knowledge, unless the mortgage company allows him to be removed, or she re-mortgages, he is on there.
Making him bankrupt will not change this either, as secured debts are not included in bankruptcy, and if there is equity in the property (althoguh you states there is not), this could complicate matters even more.
I hope this has answered your question.
