What About My Assets If My Husband Goes Bankrupt?
Question: Husband was made bankrupt & automatically discharged end last year
Husband discharged bankrupt end last year. Just had letter from trustee wanting to send someone to our home to value assets. I have received some of my late mums china/jewelery from my dad how do I stop them valuing these as they are not joint, do I need to return them to my dad? Also my adult children both have rooms full of their own belongings (one had their own home but returned home with all furniture etc..) how do I protect these?
Answer: I am a bit confused due to two points:
One is that once a bankruptcy has been discharged it is over, and unless the Trustee placed a charge on the property, the bankruptcy is over and they have no claim.
Secondly, in bankruptcy your personal possessions are not looked at unless you have expensive jewelry or antiques, and then it would only be the person who has gone bankrupt’s property, not anyone else’s property.
I would advise contacting this Trustee and clarify exactly what is happening, and also confirm the bankruptcy has been discharged.
