Can Bailiffs Take My Property For My Partner’s Debt?

Question: My house mortgage and all the bills are in my name, I own the lot. I have a 15 year old son and about four years ago my partner moved in with me. He has outstanding tax bill and they have given the debt to an debt collection agency who said if he doesn’t pay they will send bailiffs around. Can they take anything in my property as it all belongs to me.

Answer: If bailiffs come around you can simply not allow them access into the property; they cannot force entry except for certain debts such as fines, etc.

If they do enter, you can state what property is yours and what is your partner’s; this can be tricky as you may need to prove what is yours through receipts, etc, but it should not come down to this as in order to have bailiffs sent out the creditor in question would need to obtain a CCJ and then an enforcement order to act on it.
