If My Partner Goes Bankrupt Can I Get Any Money Off Him?
Question: My partner has just declared himself Bankrupt after not working for 6 months & we are loosing our home which is in joint names. He works offshore as a diver & work has been very quiet consequently we have got in a mess. He has decided he is not coming back to this country therefore leaving me homeless. I put £100,000 into our relationship which started 5 years ago – the majority of that going towards buying our house 3 years ago. He is back working now but dosnt know how long work will go on for!!
I am 56 & have no dependant children
We have the property up for sale but there is no equity in the house

My questions are:
Where do I go to get help to find somewhere to live – my income is only £10,500 a year
Am I entitled to my money back off him
Should he ensure I have somewhere to live
Answer: You can inquire with your local Council or Citizen’s Advice Bureau as to your eligibility for council housing or with an association; they also can advise you of any benefits you maybe able to receive.
If the property is in both your names, only his portion of any equity would be taken for the bankruptcy, once sold, you should receive any proceeds that are yours.
You may be best to speak to a solicitor as to any claims you may have to what other assets he may have.
