My Ex Is Worried My Bankruptcy Will Effect Her Flat?
Question:
I have been living with my ex for last 10 years and the property is on her name. Now we made an amicable divorce about 3 months ago. I lost my job, and I have been left with £20k debt. I decided to go for bankruptcy but my ex she is very worried about her flat. What can I do to convince her.?
Answer:
I am unsure what you can say or do to convince her things will be OK.
If you have no joint debts then your bankruptcy does not directly affect her.
Since you had lived with her for ten years, and in bankruptcy the forms will ask where you have lived for a period of time, it will come out you lived with her.
Since she has a property, the Receiver may look to see if you contributed to that property in anyway; paid the mortgage, council tax, upkeep, etc, and if so try to establish you have a beneficial interest in the property.
I cannot say based on the limited information you have provided if the receiver will do this or not, of if they can show a beneficial interest, but it is something to keep in mind.
Thank you for letting me help you.
Jon
