How Should I Fill Out My Bankruptcy Forms?
Question:
My wife lost her job due to back problems and is now registered disabled. My fixed rate mortgage came to an end and the monthly repayments increased massively. The house was re-possessed.
My wife gets various benefits which contribute to the household bills. She pays a sky subscription, she has a newspaper delivered daily, plus other outgoings would not be allowed in the bankrupcy if they were in my name, but they reduce the amount she can contribute to the allowable household bills. As these are her outgoings and not mine, how much of her income do I include on the statement of affairs form?
Answer:
If it is just yourself going bankrupt, you can show your income and what bills you pay.
If you were to just show your income and what bills you pay, this is an accurate picture of what you receive as wages/income, and what your expenses are; if the Official Receiver had any questions they can address them with you and you can explain in more detail if need be.
If they request information on this as she is just receiving benefits, they will not be used as a part of your bankruptcy or payments into a bankruptcy. It may be the OR just needs to see who pays what bills.
