Can I Include Utility Arrears In Bankruptcy?
Question:
My husband and I are seperated, i have just moved from a rented property to another privately rented property, i am on benefits and have not paid in full my electric and gas supplier from the previous property. my new property is with another supplier, i have personal debts which i cant meet and my husband is struggling to pay the mortgage and secured loan on his property and we have been advised to go jointly bankrupt.
Am i able to include my electric and gas debt from previous supplier within the bankruptcy.
i also have debts with both water suppliers from the previous property, am i able to include these in the bankruptcy or will this effect my supply in the new property.
Answer:
You ask a good question and one that many people are concerned about; yes, you can include water, gas, and electric arrears in bankruptcy.
The issue with doing this is that if you are still using that supplier, they can stop their service to you, so you would want to be using a new r different supplier where you are now living.
If you are using the same supplier and cannot switch, you can wok out a repayment plan outside of bankruptcy as these are considered a priority bill and are allowed to be paid outside of bankruptcy.
Thank you for letting me help you.
