Will My Stock Be Taken In Bankruptcy?

Question:

Is it true that if I file for personal bankruptsy and I am self employed as a sole trader, that the receiver can take my business stock?

If it is, then it would put me out of work because I wouldn’t have any stock to sell.

Answer:

In bankruptcy you are allowed to continuing trading and depending on the nature and value of the stock you would be allowed to continue and the OR would not take or sell off the stock.

It could also be the stock is protected as a part of the trade or tools of the trade in your bankruptcy.
