Discharged Bankrupts Death

Question:

My husband died the middle of last year and was a discharged bankcrupt. He was made bankrupt in 1996. I have received a payout from a pension fund at the beginning of November but have received a letter two months on stating that I have to pay back this payment to them. We have used this money to pay off my late husbands debts and to pay for his funeral. Can the pension company ask for this money back? As I am now a single parent with two young children I am in a very difficult position as I do not have this money to pay them it back

Answer:

I am sorry to hear of your loss. If he was discharged any funds he was to receive would be his as the bankruptcy was over; however, you would need to inquire with the pension company as to how it was to be paid if he was deceased. The bankruptcy since it was discharged is a moot point in this case.
